Texting and Driving: Commercial Exposure This week, jury selection began at a trial in Massachusetts for the first motor vehicle homicide as the result of texting. These types of cases are becoming increasingly common so it is important for businesses to consider the exposures associated with any vehicle operation. If a company has employees that drive company vehicles as part of their job, that business is at risk. Carriers like The Hartford are taking these new exposures into consideration in their business auto policies. A business auto policy should help to protect a business from financial loss when an employee is responsible for an injury or property damage resulting from an accident, which could be the result of texting. Travel Agent Errors & Omissions Insurance With more and more people opting to function as home-based businesses, often times E&O insurance is thought of as more of a luxury, but actually it is a necessity. With travel agents, it can be a bit tricky because there are only a handful of insurance carriers that write E&O for travel agents – but that doesn’t mean the costs are outrageous or coverage is lacking! Travel agents represent a unique class of business because it is possible that a home-working agent may have coverage under a host agency’s policy BUT if the home agent is incorporated, they can NOT be covered under any host policy – and of course would need their own policy. There are many kinds of claims against travel agents – failure to notify of VISA needs, misinformation given with regard to arrival or departure dates after ticketing, incorrect hotel reservation dates, misinformation pertaining to port stops on cruises, clients being mugged in a foreign location deemed as ‘safe’, etc. When bad things happen, customers file lawsuits and, without proper coverage, the defense costs or damages from those suits could destroy an agent.
